Transfer of real estate from November 1 using an electronic property file

As of November 1, the hassle of transferring property is expected to be a thing of the past as an electronic property file is put into operation.

Thanks to this, the procedure can be completed in a short time, provided that the property has no outstanding issues, is registered and settled.

According to the schedule of the Independent State Revenue Administration, from November 1, 2023 all property transfer transactions will be carried out exclusively through the new electronic platform, which is currently undergoing pilot testing.

New rules

In accordance with the new system, the collection of documents will be carried out by a notary who draws up a contract for the transfer of property, after receiving the appropriate permission from the parties. The notary will enter the online platform using personal passwords and submit a request for the issuance of the necessary certificates and documents in electronic form for each organization separately. Thus, taxpayers will be relieved of the need to visit the tax office, municipalities, land cadastre, town planning department to personally submit a request.

It should be noted that the new digital application will contain all the necessary and supporting documents for the property from all involved authorities (AADE, Land Registry, Technical Chamber, EFKA), which will be extracted by the notary and entered into the dossier of the transferred property. An electronic platform called “Electronic Real Estate File” will work on the digital portal of the state gov.gr.

In the future, the interested parties and the notary who draws up the relevant deed will log in to the electronic platform after authentication using the trust codes of the General Secretariat for Public Administration Information Systems of the Ministry of Digital Management (TAXISnet) or using the credentials of the Register of Notaries, respectively. To the extent provided by the electronic platform, the interested parties and the notary may authorize other persons to perform the services provided by the platform and issue the relevant certificates.

Procedure

1. In accordance with the procedure, the notary enters the platform to request the issuance of the documents necessary to perform the notarial act and / or, depending on the situation, collect them. Supporting documents appear in a special list in the electronic transmission file.
2. It then invites the seller and buyer through the platform to accept the transfer request and grant the necessary permissions. The real estate seller selects the property to be transferred and accepts the invitation to authorize the notary to start collecting documents and information, and perform all necessary actions to draw up a notarial deed.
3. At the same time, the buyer of real estate must go through a similar procedure. An e-transfer case is created by the transferring party selecting a property to transfer, accepting invitations, and granting permissions to the notary by both parties. Thus, after the taxpayer acquiring the property pays the tax, the platform receives the necessary tax payment data from the AADE myProperty application or tax exemption.
4. Finally, the notarial deed is signed by a notary and the contract is registered in the Land Registry.

The goal of the project is to fully computerize this procedure and free the employees of the respective institutions from the intermediate service steps required for the final transfer of real estate.
