Supreme Court prosecutor orders prosecution of 11 “Spartiates” MPs for voters’ fraud

The Prosecutor of Greece’s Supreme Court ordered on Thursday the criminal prosecution of 11 MPs of the far-right opposition party Spartiates (Spartans) as well as of the jailed former Golden Dawn MP Ilias Kasidiaris, on charges of defrauding the electorate.
The head of the Spartiates party, Vasilis Stigas, is not being prosecuted. He had publicly denounced the illegal, behind-the-scenes activities within his party.
Kasidiaris, already jailed for his action within Golden Dawn, is charged with morally instigating the deception of voters, as the prosecutor’s investigation revealed that he is the true leader of the Spartiates party, who secretly controlled events and was responsible for the party running in the elections and electing MPs to Parliament.
The persecution leads to political developments regarding the seats the 11 MPs have in the Greek Parliament.
The charge is reportedly based on evidence showing that there was continuous contact between the Spartiates candidates and Kasidiaris while he was in prison and that he provided them with guidance and political support – which is forbidden under the law for him and other jailed members of Golden Dawn, which was ruled a criminal organization.
The prosecutor also ordered the prosecution of a lawyer for enabling the contacts between Kasidiaris and the MPs facing charges.
Seats in the Parliament
Already two of the persecuted Spartans MPs have declared their independence from the party which now loses its status of a “parliament group.”
In the event that the 11 MPs are convicted of this crime, the possibility increases that the Electoral Court will declare all the MPs disqualified and then indicate how the vacant parliamentary seats should be filled.
There are three possible scenarios:
1. To occupy the seats in each district with the first runners-up of the Spartans party candidates.
2. To make a proportional distribution of the percentage of Spartans they received in the elections to all the parties that participated in the elections of June 2023. In this scenario the ND will increase its percentage by 1.9% and reach 42.45% , gaining an additional five seats (163 out of 158 today). Similarly, SYRIZA will gain another three seats, while the rest will be distributed proportionally to the other parties.
3. To hold repeat elections in the 11 regions where the corresponding number of Spartans’ deputies were elected. It is recalled that the regions that elected Spartan MPs are: Athens A, Piraeus B, Athens North Sector, Athens West Sector, Eastern Attica, Aitoloakarnania, Heraklion Crete, Thessaloniki A and B and Larissa.
